Terms of Service

These Terms ("Agreement") govern your use of the AI Sales Agent platform ("Service") provided by the platform operator. By signing up, you agree to be bound by these Terms.

1. What we provide

A multi-tenant AI agent platform that automates lead capture and customer engagement across WhatsApp, Email, Instagram, Facebook Messenger, and website chat. Each business tenant operates their own AI agent under their own brand, on their own communication channels.

2. Acceptable use

You agree NOT to use the Service to:

• Send spam, unsolicited bulk messages, or content prohibited by WhatsApp's Business Policy
• Impersonate other businesses or mislead customers about your identity
• Process personal data unlawfully or beyond the consent your customers have given
• Reverse-engineer, resell, or sublicense the Service without permission
• Violate Indian laws (DPDP Act, Information Technology Act, GST rules) or those of any jurisdiction where your customers reside

3. Subscription + Pricing

• Free Trial: 14 days, up to 100 customer messages
• Starter: ₹999/month, up to 1,000 messages
• Pro: ₹2,999/month, up to 5,000 messages

Subscriptions auto-renew unless cancelled. Cancel anytime from the admin panel. Payment is processed via Razorpay; their 2% transaction fee is borne by your business (we don't take a cut of customer payments).

4. Tenant responsibilities

• You are the data fiduciary for your customers' personal data. We act as a data processor.
• You must obtain valid consent before sending business-initiated messages.
• You must publish your own privacy policy and link it from your channels.
• You are responsible for the accuracy of pricing, availability, and any commitments your AI agent makes to customers.

5. AI disclaimer

The AI is powered by large language models (Google Gemini) and can occasionally produce inaccurate or unexpected output. You agree to:

• Configure the AI's system prompt and knowledge base to reflect your accurate business information
• Review AI-generated quotes and bookings before finalizing
• Take responsibility for any commitments the AI makes on your behalf

We disclaim warranties about specific AI outputs. The Service is provided "as is."

6. Termination

Either party may terminate this Agreement with 30 days' notice. Upon termination, your tenant config and stored data are deleted within 14 days. Payment-related records are retained for the legally required period for GST compliance.

7. Liability

Aggregate liability is capped at the fees you paid in the preceding 12 months. We are not liable for indirect, consequential, or punitive damages, or for losses arising from third-party services (Meta, Razorpay, Google).

8. Governing law

This Agreement is governed by Indian law. Disputes are subject to the exclusive jurisdiction of the courts of New Delhi, India.
